Dear Governor Spitzer:
Contrary to my driving record, its "ABSTRACT" falsely shows that my driver's license, and vehicle registration is suspended.
On June 26 2006, following a traffic stop in Suffolk County, I was charged with; AGGRAVATED UNLICENSED OPERATOR MOTOR VEHICLE; OPERATING MV WITH SUSPENDED REGISTRATION; OPERATING MOTOR VEHICLE WITHOUT INSURANCE, and FAILURE TO RETURN LICENSE,REGISTRATION PLATES. The annexed abstract was the basis for the charges. (Docket #2006SU036423S)
On November 20 2006, my motion to dismiss was granted, and all charges were dismissed also, confirming that my driver's license was free and clear of all suspensions. (See attached certificate of disposition.)
On November 17 2005, following a traffic stop in Nassau County, I was charged with AGGRAVATED UNLICENSED OPERATOR MOTOR VEHICLE; OPERATING MV W/O LICENSE; OPERATING MV WITH SUSPENDED/REVOKED REGISTRATION;UNREGISTERED MOTOR VEHICLE. The abstract was the basis for the charges also. (Docket #2005NA027254)
After numerous Court appearances, over the course of several months, and the theft of my knapsack containing computer software, hard drives, and adapters, in the Courtroom, after Court officers took possession of the knapsack, I was offered the deal of “dismissal of all charges” in exchange for a guilty plea to a fictitious "no seat belt" charge, even though the results of adequate research conducted by the District Attorney, established my innocence.
I was driving with my seat belt, and I rejected the deal. On February 27 2007, I was convicted of the charges and fined fourteen hundred dollars. ($1400.00)
On Martin Luther King Jr. Day 2007, I was sitting in my "parked vehicle" at the HOME DEPOT Shopping Center in Elmont New York, when I was confronted by two uniformed Police Officers. According to Court records someone reported a "CRIME IN PROGRESS." After the interrogation, I was ordered to move, and I complied. While, still in the parking lot talking with the uniformed Officers, and on the phone, Officer Magnuson a former New York City Police Officer arrived on the scene shouting, get off the phone, get off the phone, you are under arrest, you are under arrest, there is a warrant for your arrest in New York City. I was arrested on a bench warrant from Queens County Criminal Court. (Docket #2007NA001435.)
I was charged with; DRIVING W/O SEAT BELT, AGGRAVATED UNLICENSED OPERATOR MOTOR VEHICLE; OPERATING MV W/O LICENSE; OPERATING MV WITH SUSPENDED/REVOKED REGISTRATION; and UNREGISTERED MOTOR VEHICLE. The abstract was also the evidence supporting the charges, even though my license was free and clear of all suspensions. On February 27 2007, I was convicted of the charges and fined fourteen hundred dollars. ($1400.00)
At the time of my arrest, I was deprived of my vehicle that was legally registered and insured under the guise of an "impounded" its contents included my medication. During the preliminary processing at the Fifth Precinct, Officer Magnuson was informed of my need for the medication. I was ignored, and threatened with additional charges for organizing my medication in a "pill pouch"
I have not received any treatment for hypertension since then. The results of my last physical (10/23/07) indicate that my blood pressure is elevated, and according to the attending physician I should "Beware I may be having a heart attack, or had one"
It is my understanding that the creation of a panel to find ways that would better protect the public from the dangerously mentally ill is being considered in the wake of the bloody knife attack on Susan Barron a 67-year-old psychologist, and 56 year-old chef Amarjit Singh.
Like so many New Yorkers, my income is totally dependent on my vehicle, and driver's license, which is “suspended” despite my legal compliance. I am currently homeless and penniless.
As a member of the homeless population, I am exposed to a greater degree of unwarranted exposure to danger than Ms. Barron, and Mr. Singh, in addition to gout, lung congestion, pneumonia, edema, TB, and skin infection that plague the homeless population, of which many members are mentally ill and have stopped taking their medications.
The restoration of my license and registration would be protection from that environment. I am requesting your assistance to have them restored.
